Resapass
In accordance with articles L.111-7 and D.111-7 of the French Consumer Code, RESAPASS provides fair, clear and transparent information on the terms and conditions for listing, ranking and delisting offers.
- Tender ranking criteria
The aim of the RESAPASS Platform is to ensure that your search results are as relevant as possible, which is why RESAPASS offers different ways of searching for travel services and hotel products, and uses complex, dynamic algorithms to ensure that your search results are efficiently ranked according to your selected search criteria.
The ranking of Advertisements in search results on the Platform thus depends on several factors, principally the following:
- Affinity choices via the following three options: destination, theme, number of people.
- Free search via an instant search engine for a specific service provider. This search is based on the indexing of fields from product sheets (e.g. title, offer description, categories, tags, etc.).
The results are compiled in real time, using artificial intelligence technology to extend the semantic field, to personalize results according to user navigation, and to meet marketing objectives (e.g. offering winter activities first during the winter season).
If you decide not to use these features, a default ranking will be applied, which organizes the results as described below according to the 2 offer search modes.
It is specified that there is no capital link or remuneration between the Platform and the service providers that could have an influence on referencing.
- Listing / delisting
In order to be listed on RESAPASS, an Advertisement must include complete and accurate information about the service or tourist service offered, the price, any other charges such as cleaning charges, accommodation charges, security deposits and all regulations and requirements applying to the traveler.
Advertisements whose content :
- Constitutes unwanted contact, or whose content is repeatedly broadcast or may disturb;
- approves or encourages illegal or harmful activities, or is of a sexual, violent, offensive, threatening or defamatory nature;
- is discriminatory;
- constitutes identity theft;
- infringes the rights of any third party or entity, including intellectual property rights and privacy rights;
- contains another person's personal or confidential information.
- Advertiser quality
The service providers listed on the Platform are professionals.
The fact that a professional makes allegations, gives false indications or presentations or those that are likely to mislead as to his identity, quality or abilities constitutes a misleading commercial practice within the meaning of article L.121-2 of the French Consumer Code, punishable by two years' imprisonment and a fine of 300,000 euros.
- Rights and obligations of the parties
Registered service providers and Users of the RESAPASS Platform are subject to a certain number of obligations and/or enjoy certain rights.
- Obligations of service providers
Providers are required to file a declaration of existence and choose a tax regime with the tax authorities. In accordance with Article 87 of the French Finance Act for 2016, service providers are liable to pay income tax on the activity carried out via the Platform. It is therefore their responsibility to declare the income derived from this activity to the tax authorities.
As a professional, you must register :
- To the Répertoire National des Entreprises to obtain your Siret number and the APE code for your business;
- The professional register corresponding to your activity (e.g. Trade and Companies Register, Trade Register).
For your information, we remind you that tax fraud exposes you to :
- A tax adjustment leading to regularization of the sums due (with late payment penalties),
- Flat-rate fines ranging from 1.5% to 5% on undeclared sums,
- Criminal penalties.
For more information, visit the Direction Générale des Finances Publiques website.
If you are self-employed or an employer and you carry out all or part of your business via the Platform, you are liable to pay social security contributions to Urssaf. You can find out how to declare and pay your contributions on the Social Security Public Service Portal.
- Consumer rights
RESAPASS aims to put travelers in contact with service providers and hoteliers for the sale of travel services. RESAPASS is not involved in the sale of these services.
The price is set freely by each service provider, and RESAPASS takes no commission.
- No right of withdrawal
Article L. 221-28 of the French Consumer Code stipulates that the right of withdrawal may not be exercised, inter alia, for contracts for the provision of accommodation services, other than residential accommodation, goods transport services, car rental, catering or leisure activities which are to be provided on a specific date or at a specific time. Article L. 221-2 of the French Consumer Code also excludes this option for passenger transport and tourist packages.
In the case of a purchase from a professional vendor not covered by article L.221-28 of the French Consumer Code, all consumers have the right to cancel their purchase within fourteen clear days of receipt of the goods in the case of sales of goods, or of the conclusion of the contract in the case of services.
- Contractual liability
For further information, please consult the provisions of the Civil Code relating to the law of obligations and civil liability applicable to the entire contractual relationship:
- Mediation
If you have a dispute with a service provider from whom you have purchased a product or service through RESAPASS, you may have recourse to consumer mediation.
To do this, you must first contact the service provider to try to resolve the dispute. If this approach is unsuccessful, you can then refer the matter to a consumer ombudsman.
You can find the contact details of the mediator(s) responsible for the professional with whom you have a dispute on their commercial documents (quotations, invoices, general terms and conditions of sale, etc.) or on their website.
